Brief Case : European Court of Justice

winter fuel payments

Until recently, UK winter fuel payments were paid to women from the age 60, but not to men until they reached 65. This was challenged in the UK courts by retired postman John Taylor, who claimed it was unlawful discrimination.

The British High Court asked the European Court of Justice to deliver a judgement on this in the light of European Community law.

The European Court announced that this practice did not follow community law and that winter fuel payments should be given to men and women under the same terms.
